This Agreement is made between you, the customer, and Toshiba Tec Corporation (hereafter referred to as "Toshiba Tec"). Downloading this software or starting to use the Software Programs constitutes your acceptance of the terms and conditions of the Agreement. If you do not agree with them, you should promptly exit this download page. The rights of ownership for such tangible objects as the media on which the Software Programs are recorded and the printed materials (the manual and other documents) are transferred to you. However, the intellectual property rights including the copyrights of the Software Programs and printed materials (the manual and other documents) and all other rights rest with Toshiba Tec (located at 1-1, KANDA NISHIKI-CHO, CHIYODA-KU, TOKYO, JAPAN). You assume all responsibility for the selection of the Software Programs to achieve your intended results and for the installation of, the use of, and the results obtained from, the Software Programs.

1. Definitions
The term "Software Programs" refers to the printer driver programs for Windows 3.1, for Windows 95, for Windows 98, for Windows NT, and For Windows 2000. The term "designated machine" refers to the copying machine incorporating the printer unit which you have purchased along with the Software Programs.

2. License
<1> You may use the Software Programs only for the purpose of facsimile operating the printer functions of the designated machine.

<2> You may not rent or lease the Software Programs.

<3> You may not use, copy, modify, reverse assemble, reverse compile or make any changes to these Software Programs by any method whatsoever except as provided by the terms and conditions of this Agreement.

<4> The above item not withstanding, you may make one copy of the Software Programs for backup purposes. You may not modify or erase the copyright markings included on the copy.

<5> You may not make copies of the manual or other printed materials which are provided with the Software Programs.

3. License Period
You may cancel this Agreement at any time by notifying Toshiba Tec in writing. If you contravene any item or article of this Agreement, the Agreement with you will be automatically canceled. In either of these cases, you will follow the instructions provided by Toshiba Tec and destroy or return the Software Programs and your backup copy.

4. Warranty
<1> Toshiba Tec provides a 90-day warranty starting from the day on which the printer unit together with the Software Programs was purchased. Under this warranty, Toshiba Tec guarantees that the media on which these Software Programs are recorded is free from material, manufacturing or recording defects when it is subject to regular use.

<2> Toshiba Tec does not guarantee that the functions contained in the Software Programs will serve your purposes or that the running of the Software Programs will be free from defects at all times.

<3> Toshiba Tec gives no explicit or implicit guarantees of any kind and it will not be held liable in any instances with the sole exception of the warranty made in

<1>. It also denies all implicit guarantees for the Software Programs covering product compatibility and compatibility with specific intended uses.

<4> Toshiba Tec will not be held liable in any way for damages resulting from trouble, whether direct, indirect, special, accidental or incidental, caused by the use or loss of use of the Software Programs.
